TERMS AND CONDITIONS
- Introduction
1.1 These Terms and Conditions (“Agreement”) govern the provision of videography and photography services by Parker Photography & Video Ltd (“PP&V”) to the Customer.
1.2 By making a booking and paying the required deposit, the Customer acknowledges and agrees to be bound by these Terms and Conditions.
- Supply of Services
2.1 PP&V agrees to provide videography and/or photography services as outlined in the agreed Proposal/Order.
2.2 PP&V reserves the right to make necessary adjustments to service delivery due to unforeseen circumstances.
- Payment Terms
3.1 A 50% non-refundable deposit (“Booking Fee”) is required to confirm all bookings.
3.2 The remaining balance is payable within the agreed timeframe specified in the service agreement.
3.3 Failure to make payment in full by the due date may result in delayed delivery of final deliverables or termination of the agreement.
- Health & Safety Compliance
4.1 Both PP&V and the Customer shall comply with all applicable health and safety laws.
4.2 PP&V reserves the right to refuse or discontinue work in environments deemed hazardous to staff or equipment.
- Creative Brief & Amendments
5.1 The Customer is entitled to up to three (3) minor amendments or one (1) hour of revisions at no additional cost.
5.2 Additional revisions beyond the included scope will be charged at a rate of £40 per hour plus VAT.
5.3 PP&V will correct any errors arising from its own actions at no extra charge.
- Booking Fee & Cancellations
6.1 The Booking Fee is strictly non-refundable.
6.2 The Customer may reschedule the shoot with a minimum of fourteen (14) working days’ notice.
6.3 Cancellations made within three (3) days of the scheduled shoot will incur a charge of 50% of the agreed rate.
6.4 Cancellations (24) hours of the scheduled shoot will be charged at 100% of the agreed rate.
- Limitation of Liability
7.1 PP&V shall not be liable for indirect, incidental, or consequential loss or damage suffered by the Customer.
7.2 PP&V’s liability for failure to provide services is limited to a refund of payments made by the Customer.
7.3 PP&V is not liable for data loss due to storage device failures, though reasonable attempts at recovery will be made at no additional cost.
- Ownership of Footage & Buyout Fee
8.1 PP&V retains full ownership and copyright of all footage produced unless a buyout fee is agreed upon in writing.
8.2 The Customer may purchase raw footage at a cost of £250 plus VAT.
8.3 PP&V reserves the right to use footage for promotional purposes unless otherwise agreed in writing.
- Copyright & Intellectual Property
9.1 All original material created by PP&V is protected under copyright laws and remains the property of PP&V unless otherwise agreed in writing.
9.2 The Customer is responsible for ensuring that all third-party content (e.g., music, branding) used in the project is properly licensed.
9.3 The Customer indemnifies PP&V against any claims arising from unauthorised use of third-party intellectual property.
9.4 The Customer may not sublicense, resell, or repurpose the video content without prior written consent from PP&V.
- 1 Data Protection & Permissions
10.1 The Customer is responsible for securing any necessary filming permissions, including obtaining consent from individuals appearing in the footage.
10.2 The Customer must notify event attendees of the presence of videography and/or photography.
- 1 Care & Damage to Client Property
11.1 PP&V shall not be held responsible for any damage or loss of Customer property during the course of filming.
11.2 Any additional filming required beyond the agreed scope will be charged at the prevailing full-day rate.
- 1 Confidentiality
12.1 Both parties agree to maintain strict confidentiality regarding all project details and proprietary information.
- Filming Conditions & Equipment Safety
13.1 PP&V reserves the right to reschedule filming due to hazardous weather conditions or other safety concerns.
13.2 Once the Customer has provided final sign-off on the deliverables, all project files will be permanently deleted from PP&V’s storage.
- Client Responsibilities
14.1 The Customer must ensure that filming locations are accessible and adequately prepared.
14.2 Delays caused by the Customer, including failure to provide required materials, may result in additional costs and revised delivery timelines.
- Right to Withhold Final Deliverables
15.1 PP&V reserves the right to withhold final deliverables until full payment has been received.
- Indemnification
16.1 The Customer agrees to indemnify and hold harmless PP&V against any claims arising from:
- a) Defamation, privacy violations, or misrepresentation in the final product.
- b) Copyright or trademark infringement due to Customer-supplied content.
- Additional Expenses & Unplanned Costs
17.1 Any additional expenses beyond the agreed scope, including but not limited to travel, permits, and props, must be pre-approved in writing by the Customer.
